SMS Terms of Service

Acceptance of Terms

By providing your mobile phone number and opting in to receive text message communications from Air Services Unlimited ("ASU," "we," "us," or "our"), you consent to receive recurring SMS and MMS messages from us related to your service requests, appointments, special offers, and other business communications. Message frequency varies. Message and data rates may apply depending on your mobile carrier. By enrolling, you represent that you are the authorized account holder or have the account holder’s permission to enroll.

Governing Law

These SMS Terms are governed by the laws of the State of Texas and the State of Louisiana, without regard to conflict-of-law provisions.

  • Texas Compliance: This program complies with the Texas Business & Commerce Code § 305.053, which prohibits the transmission of unsolicited text messages for commercial purposes without consent.
  • Louisiana Compliance: This program adheres to Louisiana Revised Statutes § 51:1731–1734, governing unsolicited electronic and text communications.

By opting in, you acknowledge your understanding that this consent applies in both jurisdictions and under federal law, including the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227.

Opt-In and Opt-Out

  • Opt-In: You may opt in by submitting your mobile number through our website forms, by texting a designated keyword, or by confirming your number verbally to an ASU representative.
  • Opt-Out: You may cancel at any time by replying STOP to any of our text messages. After sending STOP, we will confirm your opt-out via one final message. No further messages will be sent unless you re-subscribe.
  • Help: For assistance, reply HELP or contact our support team at info@airservicesunlimited.com or call (888) 555-ASU1.

Disclaimer

Delivery of SMS messages may be delayed or prevented by factors beyond our control (e.g., carrier issues, network problems). Air Services Unlimited is not liable for delayed, undelivered, or misdirected messages.

Arbitration and Dispute Resolution

Any dispute arising under these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

  • The arbitration will take place in the county of your residence (Texas or Louisiana).
  • Each party shall bear its own costs unless otherwise required by law.

Consumers in Louisiana retain the right to judicial recourse as outlined in Louisiana Civil Code Article 3076 and may elect to bring an action in small claims court as permitted by law.
